Responsible office

If we process your personal data as part of a recruitment process, RTS Wind AG (Am Winterhafen 3a, 28217 Bremen, phone: +49 421 69 68 00 00, e-mail: info@rts-wind.de) is jointly responsible for data processing with the respective client. Scope, purposes and legal basis of data processing

We carry out active sourcing measures on the professional networks and career portals we use, in particular StepStone, Xing and LinkedIn, in order to identify promising potential candidates for our clients and actively contact them. The data is processed exclusively for the purpose of recruitment and placement. In doing so, we individually draw the attention of interesting users to vacant job offers from our clients.

We initially only process the data that is publicly visible on your profile in the networks used for professional purposes. These are in particular: Names, contact details and information or data on qualifications/further training. The personal data is collected by us directly on the respective career platform or transmitted by it. A search in social networks that are primarily used for private purposes (such as Facebook and Instagram) does not take place. The legal basis for the processing of personal data is Art. 6 para. 1 sentence 1 lit. f GDPR. The legitimate interest arises on the one hand from the interest in recruiting suitable employees for our clients and the fact that the user profiles were published for the purpose of receiving job offers. Similar interests can therefore be assumed.

If your publicly viewable profile information is of interest to us or our clients, we will contact you via the relevant network and offer to send us your complete application documents. If you provide us with your application documents, we will process your personal data, in particular your contact details, such as your name and address, as well as all data related to the application, such as your CV, certificates and qualifications. As a recruitment agency, we process this data exclusively for the purpose of checking your application with regard to the fulfilment of the requirement profiles provided to us by our clients. The purpose of the assessment is to decide whether your application is suitable for a potential placement. Processing takes place on the basis of your voluntarily granted consent (Art. 6 para. 1 lit. a GDPR), which you give by sending the application documents and which you can revoke at any time vis-à-vis RTS Wind AG.

If your submitted application is of interest to one of our clients, data will only be transferred to the client if you have given us your express prior consent to do so. The legal basis for data processing in this case is therefore also your consent (Art. 6 para. 1 lit. a GDPR), which you can revoke at any time.

Recipients of the data and storage duration

We only transfer your personal data to our clients if you have expressly consented to the transfer. Your personal data will not be passed on to third parties beyond this, in particular not outside the EU or the EEA.

In addition, we may use other service providers who support us, for example in the areas of IT or the archiving and destruction of documents and with whom separate contracts for order processing have also been concluded.

We generally store your personal data for the duration of the application process or until you withdraw your consent, provided that deletion does not conflict with any statutory retention obligations. If you have agreed to be included in our talent pool, we will store your application data for 2 years.

Information on joint responsibility

If we accept your application as part of the recruitment process for a client, we process your personal data in joint responsibility with the respective client (Art. 26 GDPR).

As part of the joint responsibility, our client and RTS Wind AG have agreed which of them fulfils which obligations under the GDPR. This applies in particular to the exercise of the rights of the data subjects and the fulfilment of the information obligations pursuant to Art. 13, 14 GDPR.

This agreement is necessary because personal data is processed in various stages of the application process, for which either our client or RTS Wind AG is responsible as follows:

Each party shall make the information required under Art. 13, 14 GDPR available to you free of charge within the scope of its responsibility.

The rights of data subjects under data protection law can be asserted against RTS Wind AG or the client with regard to the above-mentioned process steps.

Your data protection rights

You have the right to receive information about the personal data stored about you free of charge upon request (Art. 15 para. 1 GDPR). In addition, if the legal requirements are met, you have the right to rectification (Art. 16 GDPR), erasure (Art. 17 GDPR) and restriction of processing (Art. 18 GDPR) of your personal data and to data portability (Art. 20 GDPR).

You have the right to revoke your consent at any time with effect for the future if the data is processed on the basis of Art. 6 para. 1 sentence 1 lit. a or Art. 9 para. 2 lit. a GDPR. Please send your cancellation to: info@rts-wind.de.
